Buying Property in Montenegro as a Foreigner: Legal Guide

Montenegro property buying guide

Montenegro buying guideUpdated October 2026

Foreigners can buy apartments, houses and commercial property in Montenegro on terms close to citizens, with a 3 percent transfer tax and a notarised contract. The difficult parts are not the headline rules but the paperwork behind a coastal building: whether it is legal, finished and registered. Here is a sequence that keeps a purchase on the right side of that line.

Foreign ownership in plain terms

Since property law reforms in the 2000s, individuals and companies from abroad have been able to acquire real estate in Montenegro, including building plots. The notable exceptions are agricultural land and forests, which are reserved for citizens, with limited routes through a Montenegrin company. Properties near the border or in protected coastal strips can carry additional planning restrictions.

The market concentrates on the Adriatic: the Bay of Kotor, Budva, Tivat and Herceg Novi, with Podgorica as the administrative city. Browse the available apartments, houses, land and commercial property on our country pages.

The purchase route

  1. Request a property sheet (list nepokretnosti) from the Real Estate Administration (the cadastre). It shows owners, mortgages, restrictions and whether a building is registered.
  2. Agree terms and sign a preliminary contract. A deposit of 10 percent is common.
  3. Order independent checks. A lawyer should verify the building permit, the use permit and the match between what is built and what is registered.
  4. Sign the sale contract before a notary. Since 2018 notaries have formalised and verified property contracts; the notary also calculates tax.
  5. Pay the transfer tax, normally by the buyer, within the deadline set by the tax authority.
  6. Register ownership in the cadastre, receiving an updated property sheet.
  7. Move utilities and check that the building is connected legally.

Costs and ongoing taxes

The cost picture is simple but not identical on every deal, particularly with new build, where VAT is part of the price.

A clean property sheet matters more than any discount: a cheap sea-view flat with a legal gap is not a bargain.

The legality problem

A building boom has left many structures built without full permits or finished without a use permit. Legalisation processes exist, but they can be slow, and a building without a use permit may struggle to obtain utilities, rental licences or bank financing. Ask for the building permit, the use permit and the registration of every unit. If the seller offers only a promise that the paperwork will follow, hold part of the price in escrow until it does.

Off-plan buyers should insist on payment tied to construction milestones, a bank guarantee where possible, and a clause that specifies the completion date and penalty for delay.

Residency

Montenegro's temporary residence permit can be linked to property ownership, subject to a valid ownership title, a clean record, health insurance and proof of means. The permit is renewable, and long-term residence follows five years of lawful stay. The citizenship-by-investment scheme closed at the end of 2022, so there is no passport route. Montenegro is an EU candidate that uses the euro, but it is not in Schengen, so rules for entry differ. Confirm requirements with the Ministry of Interior or an advisor, because administrative practice can change.

Living costs and season

Prices and rents swing with the summer season. Seaside towns fill from June to September and quieten sharply in winter, when some restaurants, shuttle services and even building concierges reduce hours. If you plan to live there year-round, visit in February before buying, and compare heating and damp control in older stone houses with modern insulated blocks. A reliable internet connection, proximity to Podgorica or Tivat airports and the state of the access road matter as much as the view.

Borrowing as a non-resident

Local banks lend to residents with local income and are cautious with foreign applicants; expect to put down at least 30 to 50 percent. Many buyers pay cash. Compare options in our Montenegro financing guide, and use the mortgage calculator to test scenarios.

Where deals go wrong

  • Trusting a verbal assurance that the building "is legal"
  • Buying an apartment with an unregistered share of the land
  • Overlooking monthly charges in resort complexes with pools and security
  • Dealing with an unlicensed agent
  • Purchasing in a flood-prone or landslide zone without a survey
  • Failing to register: until the cadastre shows your name, you are not the owner

For lower-ticket homes, our budget listings and homes under €100,000 need extra checking.

Frequently asked questions

Can foreigners buy property in Montenegro?

Yes. Foreign individuals and companies can buy apartments, houses and commercial property, but agricultural land and forests are generally reserved for citizens.

How much is the property transfer tax?

The tax is 3 percent of the price in most resale cases. New builds are generally subject to VAT instead, so ask the developer whether it is included.

Does buying a property give me residency?

Property ownership can support a temporary residence application, but it does not grant residence on its own, and the old citizenship scheme has closed.

What should I check on a coastal apartment?

The cadastre sheet, the building and use permits, the share of land, and the management charges. Also see that the flat has a separate legal unit.

Do I need a lawyer?

It is strongly advisable. The notary verifies the contract but your lawyer should check permits, boundaries and any claims, and report in a language you understand.

Can I get a mortgage in Montenegro as a foreigner?

Possible but difficult. Banks demand a large down payment and local income documentation, so most foreign buyers use cash or financing from home.
